Privacy Policy for SetSale

At SetSale, we are committed to protecting the privacy and security of the information handled through our software. This Privacy Policy explains what we collect, how we use it, and — importantly — how information about Contractors is shared with the Partners those Contractors choose to connect with on our platform.

This Privacy Policy is incorporated into, and forms part of, our Contractor Terms and Conditions. Capitalized terms used but not defined here have the meanings given in those Terms.

Scope — Whose Information This Policy Covers

This policy applies to:

• Contractors and their Authorized Users (employees) who use SetSale;
• Partners and their personnel who use the partner-facing features of SetSale; and
• End-customer information that Contractors input into SetSale in the course of creating quotes (for example, job-site location). Contractors are responsible for having an appropriate basis to provide end-customer information to SetSale, including any consent required for the uses described in this policy.

Information We Collect

• Personal and Account Information: When you sign up for SetSale, we may collect information such as your name, email address, company name, phone number, and billing information.
• Usage and Business-Activity Data: We collect information about how you use SetSale, including your interactions with the interface and the features you use. This includes business-activity data generated through your use of the platform, such as quotes created, quote outcomes (won/lost), sales volume, close rates, average ticket size, financing and add-on selections, equipment quoted and sold, brand and efficiency mix, and the pricebook prices you set for equipment.
• End-Customer Data You Provide: When you create quotes, you may input information about your end customers, including job-site location (latitude/longitude).

How We Use Your Information

• Providing and Improving Services: We use your information to provide and maintain SetSale, to operate the contractor–partner platform, and to improve and develop new features.
• Communication: We may use your email address to send service-related notifications, updates, and promotional messages. You can opt out of promotional messages at any time.
• Partner Integrations and Analytics:Where you have connected to a Partner integration, we use your information to provide that Partner with the performance and activity information described in "Sharing with Connected Partners" below.
• Third-Party Service Providers: We may use third-party service providers (such as email tools, hosted database providers, and cloud providers) to help operate our business and provide our services. These providers may access your information only to the extent necessary to perform their functions and are obligated to maintain its confidentiality and security.

Sharing with Connected Partners

SetSale is a platform that connects Contractors with Partners. If you are a Contractor and you connect to a Partner integration, that Partner may be able to see information about your business through their SetSale dashboard. This sharing happens only with Partners you are connected to — Partners cannot see data from Contractors they are not connected to.

When you are connected to a Partner, that Partner may see:

• Company profile: your company name, logo, email, phone, and number of active users.
• Sales performance: metrics such as quotes created, jobs sold, sales volume, close rate, average ticket size, financing attachment rate, add-on/IAQ value per job, brand-loyalty rate, and high-efficiency mix — presented in dashboards and leaderboards that may rank connected Contractors against one another.
• Quoting and equipment behavior: which equipment models you quote and sell, including for equipment sourced from that Partner.
• Employee activity: the name or email of the user who created or won a quote, with timestamps, in an activity feed.
• Network aggregates:totals and trends across the Partner's connected Contractors.

What connected Partners do not see:your end customers' names, email addresses, phone numbers, or street addresses; the contents of your quote presentations, contracts, or signatures; individual quote records listed in the dashboard; or your internal margin and pricing-strategy configuration.

Limits on Partner use. Connected Partners receive this information as channel partners to support your relationship on the platform (for example, channel support, inventory and pricing alignment, and performance visibility). Under our agreement with each Partner, the Partner may use this information only in connection with its use of SetSale to support that relationship, and may not download, export, sell, transfer, or otherwise re-share it for any other purpose.

Job-site location (end customers).When you create a quote with a job-site location, that location (latitude/longitude) may appear to connected Partners on a map as an unlabeled pin. The map does not show your end customer's name, address, contact information, or the dollar amount of the quote. You are responsible for ensuring you have any consent required to share end-customer job-site location.

Sale of Information

SetSale does not sell your personal information to third parties for those third parties' own independent marketing purposes. The sharing with connected Partners described above is part of providing the SetSale platform and is governed by this policy and our agreements with Partners.

Aggregated and De-Identified Data

We may create aggregated or de-identified information that does not identify you or any individual, and we may use and disclose such information for any lawful purpose, including improving and marketing our services. We will not attempt to re-identify de-identified information except as permitted by law.

Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).

Data Security

We implement appropriate technical and organizational measures to protect your information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, so while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

Your Rights

• Access and Update: You can access and update your personal information through your SetSale account settings.
• Data Retention: We retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, unless a longer period is required or permitted by law. Performance and activity information shared with connected Partners is retained indefinitely and remains visible to a Partner for the period during which you are connected to that Partner.
• Privacy requests: Depending on where you live, you may have rights to access, correct, or delete your personal information. To make a request, contact us at privacy@setsale.ai and we will respond as required by applicable law.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of changes by posting the new policy on this page and updating the "Effective Date" above. If we make material changes to how we share information with Partners, we will provide additional notice, such as by email or an in-app notice.
